When a foreclosed home is sold at a sheriff’s sale for more than the amount owed to the lender, the difference does not belong to the bank, the buyer or the county. It belongs to the former owner, or to that owner’s heirs. In Ohio these balances are called excess funds, and they sit with the court until someone files a claim.

According to the Cuyahoga County Clerk of Courts’ own published “Excess Funds – Foreclosure” list, reviewed by Foreclosure Recovery Inc. on September 13, 2026, the county is holding balances in 6,657 foreclosure cases totaling more than $23.1 million. More than 540 of those cases hold $10,000 or more, and the largest single balance exceeds $213,000. Most of the people named on that list have no idea the money exists.

Who is included

You may be entitled to a payment if you owned, inherited or otherwise held an interest in a Cuyahoga County home that was sold at a foreclosure sale for more than what was owed on it. Common examples include the former owner of record, a spouse or co-owner, and the heirs or estate of an owner who has since passed away. Many of the county’s larger balances are held in the names of “unknown heirs,” which means the court was never able to find the family.

Why the money goes unclaimed

Notice of a surplus is usually given only through the court file and a legal advertisement. By the time the sale closes, most families have moved, and heirs of a deceased owner are rarely told at all. Under Ohio law, court-held funds that stay unclaimed are eventually turned over to the state’s unclaimed funds program, where recovery takes longer and requires more paperwork. Foreclosure Recovery Inc. was founded to close that notification gap.

The legal backdrop

The unanimous 2023 United States Supreme Court decision in Tyler v. Hennepin County held that a government may not keep the equity left over after a foreclosure. Since that ruling, states and counties across the country have been publishing their surplus lists and, in several cases, settling with former owners who were never paid. Cuyahoga County’s list is public. The claims still have to be filed one case at a time, which is where most families lose the money.
